1. Provider and scope

These terms of service govern the use of the "Bako" app, offered by ESBM Solutions UG (haftungsbeschränkt) i. Gr., Ditfurthstraße 48, 33611 Bielefeld, Germany ("we"). By using the app you agree to these terms.

2. Description of the service

Bako is a self-service app that provides readings for entertainment and self-reflection purposes. There are no real advisors, and Bako is not a marketplace. The readings are partly generated automatically (AI) and are no substitute for professional medical, psychological, legal or financial advice. Do not make significant decisions based on them.

3. Minimum age

Use of Bako is reserved for persons aged 18 and over.

4. Virtual Stars

"Stars ⭐" are a virtual balance within the app. They have no monetary value, cannot be paid out, are not transferable and cannot be exchanged for real money. The balance of your Stars is maintained authoritatively on our server; spending them on a reading is final.

5. Bako Plus (subscription)

Bako Plus is a paid subscription with a fixed term that renews automatically for the respective term unless cancelled in time. Purchase, renewal and cancellation are handled through your app store account (Apple App Store or Google Play). For digital content provided immediately, the statutory right of withdrawal expires once you expressly consent to the immediate start of performance.

6. Content and rights of use

We grant you a simple, non-transferable right to use the app for your own private purposes. Photos you upload are used solely to generate the requested reading (see the privacy policy).

7. Liability

Due to the entertainment character, we make no warranty as to the accuracy or suitability of the readings. Otherwise we are liable only in accordance with statutory provisions, in particular in cases of intent and gross negligence as well as injury to life, body or health; liability for slight negligence is limited to foreseeable damage typical for this type of contract.

8. Changes to these terms

We may amend these terms where this is objectively justified. We will inform you of material changes in an appropriate manner.

9. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. You can find the EU online dispute resolution platform at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
